Assessment of value may present some of the more complex business and financial issues for lenders based on the nature of the assets being valued and circumstances of the valuation. The learning objective of this panel discussion is to assist attendees with developing a more thorough understanding of the valuation issues facing lenders as viewed by a lender, an attorney, a financial advisor, and a valuation expert. This panel will explore critical valuation considerations for lenders in distressed and restructuring situations, including the differences between appraisal and liquidation values across inventory, machinery & equipment, real estate and intellectual property. The discussion will address the role of inventory valuation in Chapter 11 plans of reorganization, strategies for preserving and maximizing collateral value, and other key valuation issues that can impact lender decisions and recoveries.

Kyle Sturgeon is a Managing Partner and co-founder of MERU, a restructuring and performance improvement firm that works with middle-market companies and their boards, lenders and sponsors. Over nearly twenty years he has advised businesses in transition, most often in situations where operating problems and balance sheet problems arrive at the same time. He has served in interim leadership roles, including Chief Restructuring Officer and interim Chief Financial Officer, and has represented companies, creditors and equity holders in out-of-court restructurings, Chapter 11 cases and orderly wind-downs.
His practice centers on the operating mechanics of a distressed situation: building liquidity forecasts management and stakeholders can rely on, installing cash controls, testing business plan viability, finding and executing cost and working capital improvements, and framing strategic alternatives so boards can make decisions with a clear view of the trade-offs. He has led engagements across consumer and retail, healthcare, technology and IT services, industrial and building services, agriculture and food, and energy and renewables, in businesses ranging from founder-owned companies to publicly traded issuers. Some have concluded in going-concern sales with lenders repaid in full; others have required a wind-down, and he has advised boards through both.
Before co-founding MERU in 2017, Kyle was a Senior Vice President in McKinsey & Company’s Recovery & Turnaround Services practice and a Director in Alvarez & Marsal’s North American Corporate Restructuring practice. He is a Certified Insolvency and Restructuring Advisor and received the Zolfo Cooper / Randy Waits gold medal in 2009 for the highest score on the CIRA examination. He is a member of the Turnaround Management Association and the Association of Insolvency and Restructuring Advisors, graduated with distinction from the University of Virginia with a B.A. in economics, and is based in Atlanta.
